Terms and Conditions of Sale
Last updated: October 2026
1. Who we are
These terms apply to sales by Silvermere Commerce Ltd ("Silvermere", "we", "us"), a private limited company registered in England & Wales (company number 17509422) with its registered office at 16 Stanpoint Way, St. Ives, England, PE27 5XF. You can contact us at accounts@silvermerecommerce.co.uk.
2. Current status: pre-launch
Silvermere is preparing for its first sales. At present this website is a catalogue of our planned collection: no orders can be placed, no checkout is active and no payment is taken. These terms will govern sales once trading begins. We may update them before launch; the version published on the website at the time you place an order will apply to that order.
3. Forming a contract (once trading begins)
- When you place an order, you make an offer to buy the items listed at the prices shown. A contract is formed only when we email you confirming that your order has been accepted and dispatched (or is ready for dispatch).
- We may decline an order — for example if an item is unavailable, a pricing error has occurred, or payment cannot be authorised. If we decline after payment has been taken, you will be refunded in full without delay.
- Product listings are an invitation to treat, not an offer. Photographs and descriptions are provided carefully, but you should read the full listing, including condition and grading information, before ordering.
4. Prices and payment
- Prices are in pounds sterling (GBP). The company is not currently VAT registered; if that changes, prices will state whether VAT is included.
- Online payments will be processed by Stripe. We do not see or store your full card details on our servers.
- Business-to-business sales are agreed directly and settled by invoice and bank transfer on the terms stated on the invoice.
5. Delivery
Delivery options, charges and estimated timescales will be shown at checkout and in our Delivery Information page before you order. Some orders may be dispatched directly by a third-party UK supplier on our behalf; where that applies, we remain responsible for your order.
6. Your right to cancel (distance selling)
If you are a consumer, you will normally have 14 days from the day you receive your goods to change your mind and cancel, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. See our Returns & Refunds page for how to exercise this right and for any lawful exceptions (for example, where sealed goods have been unsealed after delivery, your right to cancel may be lost where the law allows).
7. If something is wrong with your goods
Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. If your goods are faulty, not as described or damaged in transit, contact us promptly and we will offer a repair, replacement or refund in line with your statutory rights. Nothing in these terms affects your statutory rights.
8. Collectible-specific information
- Condition and grading. Graded items are described by reference to the grading company and grade shown on the encapsulation. Grading is the professional opinion of the named grading company, not a guarantee of market value by Silvermere.
- Sealed products. Factory-sealed products are sold as sealed; we cannot guarantee the presence of any particular card or item inside sealed packaging.
- Authenticity. Where provenance or authenticity information is stated on a listing, it reflects what we have verified for that item.
9. Liability
We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or under Part 1 of the Consumer Rights Act 2015. Otherwise, our liability to a consumer is limited to the price paid for the goods concerned, and we are not liable for losses that were not reasonably foreseeable. Business customers contract on the basis that implied terms are excluded to the extent permitted by law and our aggregate liability is limited to the invoice value of the relevant order.
10. General
- These terms are governed by the law of England & Wales. Consumers may bring proceedings in the courts of their home UK nation; otherwise the courts of England & Wales have exclusive jurisdiction.
- If any part of these terms is found unenforceable, the rest continues to apply.
- Alternative dispute resolution: if we cannot resolve a complaint, you may refer it to an approved ADR body; you also retain your right to go to court. Owner to confirm whether an ADR scheme will be named here before launch.
